President Joe Biden has made it clear that he believes the needs of illegal immigrants override the needs of hardworking law-abiding Americans. Back when Biden first took office, he suspended the Trump-era “Remain In Mexico” policy on the grounds that it pushed migrants into dangerous housing.
A memo was sent out on June 1. regarding the policy and claimed that it did not “enhance” or “sustain” border management in any way. A lawsuit was filed by Texas and Missouri and argued that the suspension of the program only leads to a border crisis beyond control. They weren’t wrong.
Federal Judge Matthew Kacmaryk recently ordered the Biden Administration to keep enforcing the Trump-era “Remain in Mexico,” otherwise known as the Migrant Protection Protocols, that they’ve been trying to terminate. This is just one example among many Trump-era immigration policies that the Biden Administration is trying to get rid of. What’s the end game in that?
Even Department of Homeland Security Secretary Alejandro Mayorkas recently admitted on leaked audio that the border situation is “unsustainable.” Between halting the construction of the border wall and promising the pathway to citizenship for millions, it’s clear that President Joe Biden is putting the needs of illegal immigrants over law-abiding Americans.
Texas and Missouri argued how it was in breach of the Administrative Procedures Act (APA) and that the policy helps secure the border and fight human trafficking. They said the suspension of the program only worsens conditions at the border and allows criminals to slip into the country.
The final ruling by Kacsmaryk orders the Biden Administration to continue enforcing and implementing the policies “in good faith” until the policy has been lawfully rescinded In compliance with the APA. He also said that the federal government must have enough detention capacity to detail all of the migrants subject to mandatory detention. The Biden Administration has seven days to appeal the ruling, which they likely will.
Missouri Attorney General Eric Schmitt said that the ruling was a “massive win” and crucial for securing the border and decreasing the risk of human trafficking. This is just another setback for Joe Biden who also tried to pause the deportations of undocumented immigrants for 100 days. That was blocked by a different judge in Texas back in January.
Schmitt previously told Fox News Biden has tried to “illegally reverse” Trump’s policies since taking office on Day 1. Since then, the border has been a disaster. He said anyone paying attention to the border knows it’s been a 21-year high in border crossings, drug traffickers, and human traffickers.
Texas Attorney General Ken Paxton also celebrated the ruling, adding that it was their second immigration lawsuit won against the Biden Administration. He called it “another victory” for the two states and a “major loss” for President Biden.
Judge Kacsmaryk also said that the report failed to mention any benefits of the “Remain In Mexico” Policy. He said the memo does not address the fact that 9 out of 10 asylum claims from Northern Triangle countries are found non-meritorious by federal immigration judges. He said the policy discouraged illegal immigrants from traveling and attempting to cross the border in the first place.
“At the very least, the Secretary was required to show a reasoned decision for discounting the benefits of MPP. Instead, the June 1 Memorandum does not address the problems created by false claims of asylum or how MPP addressed those problems,” Kacsmaryk said.
While the ruling has been placed on hold for 7 days, it’ll be interesting to see how the Biden Administration tries to spin and challenge it. The Biden Administration has been ignoring the rules and we’ll have to keep a close eye on this. They also ignored the SCOTUS ruling that the CDC can’t set policies extending the no-eviction policy. Biden’s border management is a sinking ship and hopefully, they’ll follow the ruling (and the numbers) for once.
